America's Tire Co. Wrecked my car. Advice and steps?

I went to get the tires changed on my car (2006 Honda Civic SI). Pretty straight forward, wouldn't you say so? Long story short, the tire guy bringing the car in was hit by another car. The driver side was hit and the air bags deployed. The damage looked pretty extensive. The manager and assistant manager assured me they were going to care of it. A claim was given to their claims office. After talking to the claims guy, he says if worse comes to worse, they'll pay me the value of the car.

Here's were I have some problems:
The KBB of my car is about $7.5k. I'm assuming that if the car is totaled, that's what they'll give me. Now I have to search for car and there's way more expenses involved in that. I have a feeling it's not going to be enough. Is there any advice or any certain steps I should take for the situation to be more in my favor?

I get my tires changed, they wrecked my car and pay me an insufficient amount of cash? That doesn't roll with me. They've severely inconvenienced me and I don't think a normal payout (like any other insurance would do) would suffice.

Interesting questions. First off keep this KEY POINT in mind. This is a negotiated settlement situation.
Meaning there may be reasonable and customary processes, but there's not a specific arbitrator or manager of this. Also take your time and have no doubt they will want to settle the matter, they may be friendly, but they also don't mind if you end a break-even or short on the deal.
1. You could call your insurance company get a claims manager assigned and say I want X, Y, and Z and let them deal with it.
2. Hire an attorney.
3. Work out a deal yourself.
First off tell insurance company to set you up with a rental car, now. They put it on their account, DO NOT let them say Oh you pay and then we will pay you back.
And you are right that it is not exactly like a regular accident, but if employee was not at fault or not negligent, then it is more like a regular accident, except they will pay the claim as business.
The key issues is accident value lost, ie your car fixed up is not worth what it was before, a buyer will pull a car fax and most likely pay less than if not in an accident.

I'm guessing it is totaled. Air bags are very expensive, and it had to be a serious hit for those to deploy, so is the frame off line, or transmission housing cracked, etc?
If it were me I would find three similar cars for sale that are a slight upgrade, so you say pay me the value or buy me one of those cars.

Well if shop employee was hit by another driver it goes under the other drivers insurance. So America tire and other drivers insurance have to settle this. But talk with your agent for more advice
