What can I do with my totaled car

My car was hit outside my house while it was parked at like 5:00Am. The person who was driving had a Hertz rental vehicle. I also belive that they were drunk. Long story short I forgot to pay my insurance the night before and it lapsed at 1200Am right before my car was hit.

I contacted Hertz and they said they don't know who was driving the car and who or why they had it and there were no records of a rental of that car. They sent me over to their insurance company which is ESIS, and they also told me the same thing. They also don't have the police report of the accident and when i've called the police department myself, they haven't filed it either. I have to give it at least 45 days before the department has the information.

I'm basically getting the run around from both sides and I don't have the contact information of the other party, only the address. ESIS has stopped picking up my calls altogether, I call everyday.

My car is a 2014 Honda Accord, I paid half but a Credit Union technically still owns it. There's about 11,000 more that I owe and i'm still paying the insurance and the monthly car payment which is about 600 in total…

You should have contacted a lawyer weeks ago. It's clear that someone is trying to get out of paying what they owe you. How do you know it was a Hertz rental car? Did you get any contact information? You called the police and reported the incident immediately? There's a police report.

You are leaving something out. Your story isn't adding up. Get a lawyer.

You are either trolling here or not too bright. How did you know it was a Hertz car? Were you standing there close enough to see the small Hertz sticker? Why didn't you call the police immediately? So your insurance lapsed just hours earlier, but later you say you still pay insurance? You are still calling ESIS and Hertz even though it's not their car? You have contact information for the party that hit your car?

Odd that you had the same problem in your post of 2 years ago. No so odd that your posts before that were about trimming your cannabis plants. 3 guesses what you've been doing for 2 years!

You need to file the police report yourself. Did you get the license plate number or the VIN number of the car? How do you know it was a Hertz rental car? Where there paper plates on the car? You need to post more information.

First, and most importantly, stop calling, immediately. Calling everyday is one of the worst possible things that you can do, because it tells them that if they do nothing, then all you will do is to keep calling.

Next, without calling, send a written letter by certified US mail, return receipt requested. This is very important because it makes clear that if they continue to do nothing then you will do more than just call, and might be preparing to sue.

How do you know it was a Hertz rental>>?

Who told you it was a Hertz rental? It looks to me that the car that hit you was NOT a Hertz rental. First you say you don't have contact information on the driver and then you say that you have his address? (" I don't have the contact information of the other party, only the address"). I suggest you wait for the police accident report or use the address that you say you have to find the driver and get his insurance information .A police report does not take 45 days to obtain. They are Usually available in a few days or a week.

… Sorry but your "story" has ample evidence of it being a nothing but "fairy tale".
First you say your insurance lapsed just before the accident but then you go on to tell us that you are still paying for insurance? How can that be? And… You say your car was "totaled" but… *Only* insurance companies can total a car and you tell us that you have no insurance and Hertz claims their car did not hit you so their insurance hasn't been used. Who determined that your car was totaled? In addition you have asked this same question more than once here on Y/A and another time you claimed your car was a 1973 Dodge?

Then you ask about cutting leaves off of cannabis… I suggest that your brain has already been damaged.
