Can I sue a mechanic for not fixing the car?

Here is the story. Last year our Honda broke down. We took it to a shop and he tells us it is the transmission. We decide to take it to the shop that we have taken the car to since we bought it in 2013. I'm %100 against this I have been against going to them since the second time they put an engine in the car but it is not mine it is my boyfriends so ultimately his decision. They take a look and decide it is the transmission as well. We pay 1800 for them to fix it. When we get the car back we had it a few days then the same thing happened to it that happened to it when it stopped working. We take it back they work on it we get it back, less then a week later it does the same thing. We take it back and they take it to a Honda dealership who decide it is the brain and that 1500 dollars might fix it. I seriously feel like they have messed up this car just like they messed up our first car. We're in so much debt from trying to get this car fixed and no car!

See a lawyer. How old is the car? When an engine is broken for an engine or transmission and the car is fairly old, it is always better to junk the car.

Already asked and since it's not your car you can't do anything anyway.

Did the repair come with a written guarantee? I assume not and it is your boyfriends fault. You can't replace the engine for $1800 never mind the transmission also. They probably spray cleaned the engine and told you they replaced it. It sounded too good to be true at that price and was.

You should sign (and get a copy) of any work order for jobs that big… The garage will try and get you to sign something like "replace transmission - $xxxx" - and if they do that, they're off the hook even if that doesn't fix the problem. You should only sign something like "eliminate noise", "car won't move - correct", etc.

No the car is not yours. YOU can't sue anyone.

Here is a novel idea. Get your own car and then you can make the decisions. You were told to but out of it. You are not married. There's no we here. You were 100% right walk away and get a life of your own.
Many techs get fooled by bad trans modules. Some outfits will help you get a module at cost. But not if you go the sue route. Entitled one.

No, even if it were your car.

There are two sorts of things you can ask of a mechanic:
1) To perform a certain repair, like replace the engine.
2) To correct a problem, like the car not moving
They are two entirely different things. It you ask for the engine to be replaced, there's no guarantee the car will move, even if that was the expectation of the mechanic. If you ask for the car to move when done, you are giving carte blanche approval for all necessary work (engine transmission, transmission control module, maybe more) to make it so.

#2 is rarely a good idea - the bill can be several times the value of the car.

NEVER, EVER take a car back to a dealer who consistently did a sh! Tty job. Why reward poor workmanship? Apply some Darwinism here…
Go see your consumer services people and see what options you have. They took money but failed to fix your car. You should be entitled to some of your money back.

I think you are right but suing him is not an option. He put in his time even if it failed.
What I do is develop a strong sense for a bad attitude and go somewhere else. It is luck of the draw. And the cards are stacked against you. I would never commit to that kind of money without a clear view ahead, either comprehending the technical part or else a second opinion. You have to be very proactive to maintain cars, more so than most people want to be. But if you find a good one then you can forget about the coo-coos.

Hi so when a car needs that sort of work it should be back to a main dealer. As any other mechanic is not going to have the diagnostic equipment to diagnose and repair such an item.
