My car was towed this morning. I was ready to take it back today, but the yard won't let me until Monday, and are charging $35/night. Legal?

My car is a honda fit and was empty except for an UberEats bag and a full glove box. It does not take 24 hours to check it in. Plus it's Friday and they are closed on the weekend so gosh darn there's another $70 that they have to charge me. My wallet was in the car, though. Is it legal for them to hold my property for three days when I'm ready and able to pick it up? It was repossessed, I'll admit, but I got the funds and had all day for the bank to clear it. They are costing me business too because I had appointments today.

Is it legal? Hell no! The same thing happened to me. I loaned my truck, the guy got busted for DUI and around 1 am Saturday morning I get a call from the police telling me this and where my car was.
I was there at 9 am and the place was closed for the weekend. I called the number on the door and left a message. Long story short they charged me and I sued them and won

Sue.

They are closed but they still have to hold your car.
AND Monday is President's Day so they may be closed then as well.

Not only is it legal, it is SOP nearly everywhere. If the car was being held in a government owned impound yard, you would be lucky to get off that easy. It would take them a week ti figure out they had the car.

They have their policies… Many impound lots only work during normal business hours. They have their policies and procedures. They aren't obligated to make an exception.
They aren't obligated to be open late or weekends just to cater to people who can't obey the laws or keep their end of contracts. That's not how it works.

YOU cost yourself more money by letting the car get repossessed in the first place. They did NOTHING except store the care for the repossession company/lienholder.

Who keeps their wallet in the car? Seriously?

Keeping your wallet in your car? HUH, that is just plain stupid.

The main problem you have is that this happened on Friday and most banks do (not) clear any checks till midnight and will show up the next day, Saturday, but in many banks checks or even with drawls won't show till Monday. So either way it is unlikely you would get your car back till Monday.

I notice all the times, since many of my credit card checks or even my utilities that are automatically deducted each month, if it falls on a weekend, won't see on my checking account till Monday.

Now you like many people may like to work only 5 days a week, like Monday to Friday and have the weekend off, so it appears the lot feels the same way, and they are not going to open for (each) person that gets unlucky to have their vehicle towed.

It's perfectly legal. What makes you think that you should get to tell them to get over there and open their business just for you? You get the car during their working hours. And you pay what's due then. You are not allowed to get into the car for any reason until you pay and pick it up.

Depends on local law.
