Legally define a 49CC dirt bike as a Moped?

The California laws says that in order for a vehicle to count as a moped it has A "motorized bicycle" or "moped" is:

A two or three-wheeled device, capable of no more than 30 mph on level ground, and equipped with:

- Fully operative pedals for human propulsion.
- A motor producing less than two gross brake horsepower and an automatic transmission.
- An electric motor, with or without pedals for human propulsion. (CVC

- Must wear a properly fitted and fastened bicycle helmet.

Therefore, when I turn 16, can I ride my 50CC honda z on the road. It can't go faster than 30mph, It has pedals welded on the side, and a automatic transmission. It also (of course) proudces less than 2 horsepower. Could I ride it on the road? Are there any restrictions?

"Fully operative pedals for human propulsion." Means the moped can move by pedaling when the motor is not running. Welding pedals on the side of the bike will make it move, and it is not a moped. It is still a motor-driven cycle, a motorcycle, and will not be legal on the streets. You will need to register and plate your 50Z as a motorcycle. You will need your Class-M1 permit, license, or endorsement.

At age 15.5 you can take and pass Driver's Education and Driver's Training (on a car.) Get the certificates and get a motorcycle permit, as soon as you get the certificates, before you are 16. You take and pass the CMSP class, get the certificate, go back to the DMV 6 months after you got the permit and merely swap the permit for your license.

  • My Moped Stopped Working, What's Wrong with it? (Honda Aero 55 1983')? I have a Honda aero 55, 1983 and I was riding it one day when it just shut off out of nowhere. I've had it about a year now and never had a problem. Oil and gas is full and when I kick start it, it sounds normal just doesn't start. Also the battery isn't bad, charged it over night and tried it with no hope. Any ideas?

When I slowly give my moped gas it runs fine until I hit about full throttle, then it like starts to bog down, its hard to explain but we think its a carburetor problem. Due to the previous owner taking off then air cleaner for an unknown amount of time. If you can give me tips/advice I'd appreciate it.
  • Where in eastern PA can I legally ride my dirt bike? (trails/parks)? So I've been riding my 1979 Honda XL for a few months now (first bike) and I'm really interested in riding offroad now. The only place I can ride dirt right now is at a construction site down the street. Where are there any trails or parks that I can legally ride at in eastern PA or within a reasonable distance of West Chester, PA. (or any places that aren't so legal but fun to ride at… Haha)
